The Freedom & Liberty Tea Party is currently posting an online petition to determine if there is enough interest in the registered voters of Montana to recall Senator Max Baucus.

This is not an actual recall petition, but a petition to gather signatures of registered Montana voters who are interested in recalling Senator Baucus. If enough signatures are gathered in favor of having such a recall of Senator Baucus, then a formal recall will be initiated under the guidelines specified under Montana law. 
 
The recall of elected officials is allowed under Montana law, pursuant to Montana Code 2-16-603, on the grounds of  physical or mental lack of fitness, incompetence, violation of oath of office, official misconduct, or conviction of certain felony offenses.

There are some that believe that it is impossible to recall a US Senator from his elected office, and that the only way that one can be removed is by his peers in the Senate. We believe that the people of Montana can recall him from office under existing state law.

The Constitution of the United States, which is the supreme and definitive document governing our nation, states that Senate itself has the sole power to impeach a Senator.
However, the Constitution does not address the issue of recalling Senators by the voters of the state that elects them. Impeachment and recall are different methods of removal of office and cannot be confused with each other.Impeachment is a type of trial by one's peers;
recall is a system whereby elected officials may be removed from office by popular vote.

The 10th Amendment of the US Constitution specifically states " The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people".

The registered voters of Montana are the persons who elect their US Senators, and no one else has a vote in their election except Montana voters. We firmly believe that since Montana law allows for the recall of elected officials, and the US Constitution does not prohibit it, we the registered voters of Montana have the right to conduct a recall of any and all of the officials we elect, including US Senators.
